(The “Contest”) OFFICIAL RULES
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.
A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
PERIOD: Contest begins at 12:00 p.m. Central Standard Time (“CST”) on April 5, 2024 and ends at 12pm CST on April 24, 2024 (the “Contest Period”).
Geographical and Age Requirements: Unless otherwise specified, each Sweepstake is open to all legal U.S. residents who are at least 18 years of age or older at time of entry and reside in the state of Texas and is void wherever prohibited or restricted by applicable federal or state laws and regulations.
Sweepstake Entity and Immediate Family Member Disqualification: The officers, directors, employees, contractors, and agents of Austin Arena Company, LLC (“Moody Center “) and any entity involved in the sponsorship, development, production, implementation and distribution of any Contest as well as their respective parents, affiliates, divisions, subsidiaries and successor companies (the “Contest Entities”), and their immediate family members (and those living in the same household, whether or not related), are prohibited from participating in any Contest and do not qualify as Participants. “Immediate family members” shall include spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws”, or by current or past marriage, remarriage, adoption, co-habitation or other familial extension.
Employer Restrictions: Participant is solely responsible for reviewing and understanding Participant employer’s policies regarding Participant’s eligibility to participate in Contest. Participant may be disqualified from entering into this Contest or receiving prizes if Participant is participating in this Contest in violation of their employer’s policies.
HOW TO ENTER:
- Submit your wholly original artwork to: Marketing@MoodyCenterATX.com or mail to Moody Center (Poster Contest) 2001 Robert Dedman Dr, Austin, TX 78712., ATTN: Marketing Department. If mailing, must be shipped unfolded in a tube or flat – NO FOLDED CONTEST SUBMISSIONS.
- The submission email or mailing must include contact information consisting of your name, email address, phone number, and address.
- The poster must showcase Bad Bunny’s two nights at Moody Center in Austin on April 26 & 27, 2024.
- Posters must be unmounted and no larger than 18″ x 24″ or 24″ x 18″.
- A PRINT QUALITY (300 dpi) jpeg, pdf, or png file is required for digital submissions.
To be considered for the Contest, each submission (“Contest Submission”) must be received no later than 12pm on April 24, 2024.
Sponsor reserves the right to allow for minor deviations from the guidelines and restrictions set forth herein, based on clear intent to comply with these Official Rules, as determined by Moody Center in its sole discretion. All Contest Submissions become the sole property of Moody Center and will not be returned and may be used by any Contest Entity for any purpose whatsoever related to any Contest, without additional compensation to the Participant or any other individual or entity. By checking the relevant box or selection in the registration form, entrants agree that Moody Center may contact the entrant via email or phone with information about promotional offers. If you do not wish to receive these materials do not check the relevant box in the entry form. If at any time you do not wish to receive these materials in the future, please use the unsubscribe procedures contained in the email message.
PROHIBITED CONTENT: Contest Submissions may not contain, as determined by Moody Center, in its sole discretion, any content that: is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity; promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Contest Submission; defames, misrepresents or contains disparaging remarks about Moody Center, its products or services, other people or companies; contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, to the extent permission is necessary; contains copyrighted materials owned by others (including music, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission, to the extent permission is necessary; contains materials embodying the names, likenesses, voices, or other indicia identifying any person (living or dead), such as license plate numbers, personal names, e-mail addresses or street addresses, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, to the extent permission is necessary; communicates messages or images inconsistent with the positive images and/or good will with which Moody Center wishes to associate; and/or violates any law.
Contest Submission must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If Contest Submission includes the name and/likeness of a minor, entrant must be that minor’s parent or legal guardian. If a Contest Submission contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Contest Submission, any and all releases, permissions and consents necessary to permit the use and exhibition of the Contest Submission by Moody Center in the manner set forth in these Official Rules, including, without limitation, permissions from any person who is mentioned in, appears in or is identifiable in the Contest Submission. Moody Center reserves the right to request proof of these permissions in a form acceptable to Moody Center from any entrant at any time. Failure to provide such proof may, if requested, render Contest Submission null and void. By submitting a Contest Submission, entrant warrants and represents that he/she and any persons who are mentioned in, appearing or identifiable in the Contest Submission consent to the submission and use of the Contest Submission in the Contest and to its use as otherwise set forth herein.
By submitting a Contest Submission, entrant represents and warrants that the Contest Submission conforms to these Official Rules and understands that Moody Center, in its sole discretion, may disqualify the Contest Submission for any reason, including if it determines in its sole discretion, that the Contest Submission fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Moody Center, in its sole discretion.
USE OF CONTEST SUBMISSIONS: By submitting a Contest Submission, entrant hereby grants to Moody Center a nonexclusive license to reproduce, distribute, display, perform, and create derivative works based upon, or otherwise exploit the Contest Submission in any manner or media now known or hereafter devised throughout the world in perpetuity for advertising, promotional and other purposes, without further compensation, notification or permission. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Contest Submissions by third parties. Moody Center has no obligation to make use of the rights granted herein.
WINNER DETERMINATION:
All eligible Contest Submissions will be judged in accordance with the following criteria: (i) Content (25%); (ii) Creativity (50%); and (iii) Originality (25%). A panel of qualified judges will do a screening of all entries for compliance with the rules and adherence to the judging criteria and will then select a winner. Such judges shall determine adherence to the judging criteria in their absolute and sole discretion.
The winner of the Contest will be determined based upon the number of qualifying votes received. All Contest Submissions and the votes each Contest Submission receives are subject to verification by Moody Center and must meet all eligibility requirements before Contest Submission may be confirmed as a winner.
The one (1) Contest Submission that receives the overall highest score will be deemed the winner (Potential Winner). In the event of a tie, Contest Submissions will be re-judged based on the same criteria listed above and a winner will be determined by Moody Center in its sole discretion. Moody Center reserves the right to not award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Contest Submissions.
Decisions of Sponsor and judges are final and binding.
The Potential Winner must comply with all terms and conditions of these Official Rules, and winning a prize is contingent upon fulfilling all requirements. The Potential Winner may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within 24 hours of the date of notice in order to claim his/her prize and become an official winner (“Official Winner”). If a prize or prize notification is returned as undeliverable, a Potential Winner cannot be contacted, is not incompliance with these Official Rules or fails to sign and return the Affidavit of Eligibility and Liability/Publicity Release within the required time period, the Potential Winner may be disqualified and forfeits the prize. In the event that a Potential Winner is disqualified for any reason, Moody Center will award the prize to a runner-up.
PRIZE: The Contest Prize is as follows:
One (1) First Prize Winner will receive one (1) Loge Box (Four (4) tickets + one (1) parking pass) to Bad Bunny’s concert at Moody Center on April 27, 2024 (Approximate Retail Value (ARV): $3,000).
Total ARV of Contest Prize(s): $3,000
Prizes are awarded “as is” with no warranty or guarantee, either express or implied. No transfer, assignment or substitution of a prize is permitted. Any difference between the actual value and the approximate retail value of any prize will not be awarded. No substitution or cash equivalent will be made. Moody Center reserves the right to substitute a prize of equal or greater value if the awarded prize is unavailable for any reason. If tickets to an event are awarded as a prize, Moody Center is not responsible for any cancellation or rescheduling of the event for any reason and has no obligation to reimburse, refund or otherwise substitute the tickets for another prize should the event not be rescheduled, or vouchers not issued. Should travel be part of the prize, Moody Center is not responsible for cancellations or delays in travel accommodations and has no obligation to reimburse, refund or otherwise substitute any tickets awarded as a part of a travel prize due to such cancellations or delays.
By participating in this Contest and accepting any Prize, each participant agrees to abide by all applicable laws as well as all policies in force by Moody Center, including, without limitation, with respect to use of the Prize and attendance at the event. Moody reserves the right, in its sole discretion, to refuse to honor any Prize if too few entries are received or if the participant claiming it is unruly, disruptive, uncooperative, fails to comply with any policies of Moody Center, or may or does cause damage to any person, property, or the reputation of Moody Center. The Prize, including any additional restrictions, is at Moody Center’s discretion.
TAXES: The prize-winner is solely responsible for determining and paying all federal, state and local taxes (including any sales taxes). A winner may be required to fill out a 1099 tax release form.
PUBLICITY: Except where prohibited, participation in the Contest constitutes Official Winners’ consent to Sponsor and its parent, subsidiary and affiliated companies and their designees to use his/her name, likeness, photograph, voice, opinions, biographical information, hometown and state for advertising and promotional purposes, in any manner, in any and all media now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission.
PRIVACY POLICY: Personal information provided in connection with this Contest will be used in accordance with Moody Center’s Policy, which can be viewed at https://moodycenteratx.com/privacy-policy/.
GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled Contest Submissions or emails or postage-due, damaged or illegible mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties or other errors or difficulties of any kind whether human, mechanical electronic, computer network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Contest Submissions, the announcement of the prize or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Moody Center reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Contest, as determined by Moody Center in its sole discretion. In such event, Moody Center reserves the right to award the prize using the winner determination procedure set forth above from among the non-suspect, eligible Contest Submissions received up to the time of the impairment. Moody Center reserves the right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner and void all associated Contest Submissions. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, Moody Center reserves the right to seek damages and other remedies (including, without limitation, attorney’s fees) from any such person to the fullest extent permitted by law. Sponsor’ s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute regarding Contest Submissions received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
RELEASE/LIMITS OF LIABILITY: By entering this Contest, each entrant and Official Winner agrees to release and hold harmless Moody Center, Austin Arena Co., LLC, its parents, affiliates, subsidiaries, officers, directors, shareholders, agents, employees and all others associated with the development and execution of this Contest (collectively, “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Contest or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Contest, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
DISPUTES: All Contests shall be governed by and construed in accordance with the laws of the State of Texas, without reference to its conflict of laws principles. By entering the Contest, Participants hereby submit to the jurisdiction and venue of the federal and state courts of Texas and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. In no event, will any Participant be entitled to injunctive relief or equitable relief of any kind, or restrain the continuation of any Contest.
